    Legal Separation

    Have you ever wondered if you could get a divorce without getting, well, a divorce? Insurmountable marital issues often bring couples to the brink of making a decision about whether or not to stay together. However, either one or both individuals may not be ready to file for divorce. So, when a marriage is in trouble and divorce appears to be on the horizon, many couples opt for legal separation before dissolving the union.

    In many ways, legal separation is a preparatory action that helps establish certain parameters prior to legally ending the marriage – but without granting a divorce. It gives the court the authority to make decisions about:

    • Custody and visitation.
    • Alimony/spousal support.
    • Property division and benefit allocation.

    While some spouses prefer to go straight for divorce, other couples may find legal separation to be preferable to maintain a legal union for different purposes. For example, a couple with religious convictions that find divorce an unacceptable option may wish to obtain a legal separation instead. Yet, many couples wish to stay legally married while having court-ordered custodial and fiscal boundaries in place to protect their familial infrastructure or finances.
